THE Davao City Prosecutor's Office has recommended the filing of charges against a man and a woman accused of killing a two-year-old who was left under their care.
Prosecutor Panfilo Junior Lovitos, in a resolution dated November 17, 2015, recommended the filing of charges against Ronilo Alcain and Sara Jane Alcain for allegedly causing the death of John Earl Cagalitan last November 13, 2016.
Based on the resolution, around 3 p.m., John Earl was seen by witnesses being manhandled, beaten and struck by respondents with a belt, broom, and hanger all over his body.
Cagalitan was rushed to the hospital for allegedly experiencing difficulty in breathing around 11:45 p.m. on the same day.
The boy was declared dead at the hospital. An autopsy report placed the cause of the death as internal bleeding in the skull due to blunt head injuries.
During the course of the investigation, the two respondents turned over themselves to police authorities saying they were bothered by their conscience.
Lovitos said that their office found a probable cause to indict the respondents for the crime of murder as there is sufficient indication that the respondents acted and worked together in taking advantage of the superior strength and killed the child.
