TWO of the five policemen accused of kidnapping Enrique Fernandez III have pending complaints at Cagayan de Oro City’s People’s Law Enforcement Board (Pleb).
A Pleb document revealed that Police Officer 2 Alaindelon Tacubao facing charges of Irregularity in the Performance of Duty and Oppression filed in 2012 while Police Officer 3 Alejandro Ubanan is facing two cases of grave misconduct in 2014 and 2015, and grave threats/grave coercion also filed last 2014.
Tacubao and Ubanan were both former members of the Crime Against Person and Property Desk unit of the Cagayan de Oro City Police Office, were identified through a close-circuit camera (CCTV) recording as two of the five suspects who abducted Fernandez at Uptown Condotel in Upper Balulang last October 23.
Three other former members of the unit, Senior Inspector Ereneo Ramirez, Police Officer 2 Jojo Lim, and Police Officer 2 Sangkula Hussein, were similarly identified.
A staff of the Pleb said the hearings of Tacubao’s and Ubanan’s cases are still on-going.
The Pleb was created by the Department of Interior and Local Government (DILG) to hear complaints against any uniformed member of the Philippine National Police.
The Pleb can withhold privileges, restrict specified limits, suspend, forfeit salary or fine, demote, and impose forced resignation and dismissal of any police official found guilty of charges.
A memorandum circular issued by the Department of Interior Local and Government states Irregularity in the Performance of Duty and Oppression, which Tacubao is charged with, is the improper performance of some acts, which might lawfully be done, while oppression, imports an act of cruelty, severity, unlawful exaction, domination, or excessive use of authority.
Misconduct or malfeasance, which Ubanan is charged with, implies to the doing, either through ignorance, inattention or malice, of that which the officer had no legal right to do at all, as where he acts without any authority whatsoever, or exceeds, ignores or abuses his powers.
