THE Davao City Special Administrative Prosecutors recorded 50 pending administrative complaints after the signing of the Executive Order No. 06 last February 22.
The head of the Committee on Investigation secretariat lawyer Elisa Lapiña said in a media interview Monday, April 10 that more than 40 complaints are involved in attendance issues like absenteeism and tardiness of employees.
"The committee recommended the review of the Human Resources Management Office," she said.
Lapiña said among the cases they are handling is a complaint against an employee who is allegedly selling gasoline from the government.
She also said two of the complaints they received are from the 8888 Citizen Complaint center.
"Ginatawag sa civil service sa amoa, ug gina-forward sa City Mayor's Office (The Civil Service forwards it to us then we forward it to the City Mayor's Office)," she said.
She added that the committee also received written and anonymous complaints.
Lapiña also said though anonymous complaints are allowed, the issuance of written and sworn statement is still highly encouraged because such documents are more useful in the next phases of the investigation.
"If you really wanted to correct something, you need to show your identity. You need to show your identity if you are telling the truth," she said.
The lawyer also said that based on their previous experiences, most of anonymous complaints are easily dismissed for lack of documentary support.
Lapiña added that anonymous complaints can only stand if it has documentary support.
"For the anonymous complaint, the city mayor can issue a show cost order that will ask an employee to explain the complaint. If he/she cannot explain it can be a ground for formal charge," she said.
She said the first hearing of the committee is set on April 26.
Lapiña said the usual process involves the forwarding of the complaint to the City Mayor's Office then the complaint will be referred to the Special Administrative Prosecutor (SAP), then the SAP will determine probable cost of the complaint and will conduct preliminary investigation.
"The special prosecutors' recommendation will go to the city mayor and the city mayor will issue formal charges," she said.
