LAWYER Juliana Carbon, former general manager of Bacolod City Water District (Baciwa), is awaiting the decision of the Board of Directors on the recent decision of the Civil Service Commission (CSC) in Quezon City ordering her reinstatement.
Carbon said over Bombo Radyo Bacolod Monday, July 17, that she’s thankful with the CSC decision, but it’s up to the Baciwa Board to implement the order.
The CSC had earlier ordered the reinstatement of Carbon after invalidating the appointment of current general manager Mario Macatangay.
The decision promulgated on July 12, 2017 ordered the payment of Carbon’s back salaries starting August 18, 2015 until her actual reinstatement is affirmed. Consequently, the appointment dated December 1, 2015 of Macatangay as general manager is invalidated, it stated.
The Baciwa Board was also directed to implement the decision of the CSC. Continued refusal of the Baciwa Board to implement the same will constrain the CSC to cite them in indirect contempt, it added.
“They were directed to implement the decision and I respect what will be their decision. For now, I cannot transfer immediately because I am also working with the City Prosecutor’s Office,” Carbon said.
She added that she will wait first for the decision of the Baciwa Board before making her final decision.
Carbon said that she already sent a letter to Baciwa informing them of her intention to return. She also asked for the release of her back salaries by July 31, 2017.
She said that her transfer from the Department of Justice (DOJ) to Baciwa will be facilitated and she asked to give her time until July 31 to turnover her responsibilities and accountabilities to the DOJ.
Carbon added that she is thankful for the love and support of the Baciwa employees, and once she returns, they will work together to address the water problem in Bacolod.
Claudio Salmo, president of Baciwa Employees Union, said Macatangay went to Manila for a week.
He said they are waiting for the Baciwa Board to convene and discuss the CSC order.
