THE Supreme Court (SC) was asked to cite in contempt the Marcos family and the military for proceeding with late President Ferdinand Marcos' interment at the Libingan ng mga Bayani (LNMB) pending the finality of the high court's decision.
In a petition for Contempt of Court filed by petitioners, former Bayan Muna Representative Saturnino Ocampo, Bonifacio Ilagan and other human rights violation victims during the Martial Law, they asked the SC to impose sanctions against Marcos' widow, Imelda Marcos, and their children former Senator Ferdinand Marcos Jr., Ilocos Norte Governor Imee Marcos, and Irene Marcos-Araneta for the secret burial which happened last Friday.
Also named as respondents are Rear Admiral Ernesto Enriquez, Deputy Chief of Staff of the Reservist and Retiree Affairs; Armed Forces chief of staff General Ricardo Visaya and Defense Secretary Delfin Lorenzana.
The petitioners believe that the respondents violated the due process of law and the Rules of Court when it continued the burial without the high court's final ruling.
The petitioners also said that they are yet to file a motion for reconsideration assailing the 9-5 ruling of the SC.
"The hasty, shady and tricky burial at the LNMB (Libingan ng mga Bayani) violates the doctrines of law that are not only clearly established in the Philippine legal system but are also so elementary. In doing so, the respondents could not have acted in evident bad faith and Contempt of this Court's jurisdiction," the petitioners said.
Aside from citing the respondents in indirect contempt, the petitioners also asked the tribunal to direct them to pay a fine and to reimburse to the government the funds used for Marcos' interment.
They also asked the SC to detain the said respondents "until they have satisfactory cleansed themselves of the contemptuous act or until such further others of the court."
Last Friday, Marcos' remains were airlifted from Batac, Ilocos Norte, to the Libingan ng mga Bayani.
The hasty burial had led to protests from different groups and universities in the country. (Sunnex)
