THE Regional Trial Court is giving the Cebu City Government and a telecommunications company 15 days to submit a compromise agreement between the two parties.
This, after Globe Telecom and the City agreed that the former will vacate Cavalry Hills in Barangay Apas in six to nine months from the day of signing of the compromise agreement.
“The parties have come to the point that an amicable settlement of this instant case would be mutually beneficial to them, thus they resolve to put an end to this case (by way of compromise agreement),” Globe Telecom Inc. said.
The company, in its main complaint on injunction, sought to enjoin the City Government from closing and shutting down their cellsite in the said area.
The City, likewise, insisted in the moving for the closure and immediate removal of the cellsite.
With both parties filing claims and counterclaims against each other, plus damages, attorney’s fees and litigation expenses, the two have decided to make peace.
This would mean that the City and Globe will withdraw and waive all claims and counterclaims they are advancing against each other.
The barangay and the homeowners, for their part, are for the settlement.
Sought for comment, Vice Mayor Edgardo Labella said the City Council will support the village, given that the latter have agreed to a compromise.
“We’ll go along with the barangay because they are the ones who are very much concerned,” he told reporters last Friday.
He said the barangay can handle it and will only need to inform the Council.
