KIDNAP convict Jaybee Sebastian has filed graft and bribery complaints before the Department of Justice (DOJ) against Senator Leila de Lima.
The complaints are in relation to the then-Justice Secretary De Lima's alleged directive that required Sebastian to sell illegal drugs inside the New Bilibid Prison (NBP).
Eduardo Arriba, Sebastian's lawyer, said his client sued de Lima for violation of Presidential Decree 46 for allegedly directing inmate leaders during her tenure as Justice Secretary to raise funds for her senatorial bid in the May 9 polls.
During a congressional inquiry on drug proliferation in the penitentiary, Sebastian said he had given de Lima a total of P10 million through her bagman Joenel Sanchez.
Sebastian also filed a graft complaint against the senator for divulging valuable information of a confidential character, as she claimed that Sebastian was a government asset.
According to Arriba, De Lima's statement claiming that Sebastian was an asset led to the stabbing incident in NBP's building 14 last September 22.
Sebastian also filed complaints against de Lima, former Bureau of Corrections director Ricardo Ranier Cruz and former NBP Superintendent Richard Schwarzcopf Jr. for their alleged violation of RA 3019 Section 5 (code of conduct and ethical standards for public officials and employees) and RA 9745 or the Anti-Torture Act of 2009.
The affidavit stated that Sebastian had suffered mental torture when he was transferred in Building 14 from the maximum facility compound.
The basis of the complaint sworn by Sebastian's wife Roxanne is the affidavit of Jaybee during the inquiry of the House of Representatives committee on justice.
Arriba said they filed the case with the DOJ and not with the Ombudsman as Sebastian's complaint is "interrelated" to the drug trafficking complaints earlier filed by the Volunteers Against Crime and Corruption and by two former officials of National Bureau of Investigation against de Lima.
