WILLIAM Guialani is accusing Cagayan de Oro City Vice Mayor Joaquin Uy and Councilor Zaldy Ocon of dereliction of duty for supposedly not carrying out their duties as mayor and vice mayor, respectively, insisting that City Mayor Oscar Moreno has already been dismissed from service.
Guialani took his complaint before the Department of Interior and Local Government (DILG)-Manila, addressing it to DILG Secretary Eduardo Ano this time, saying the DILG regional office failed to take appropriate actions against his complaints.
In his letter-complaint, Guialani said Moreno remains in office as an “untouchable official despite 35 dismissal orders served against him”.
“To make good of the campaign of President for ‘Tunay na Pagbabago’, we are appealing to implement the recent Ombudsman decision dated December 12, 2017 and other cases where the temporary restraining issued have already expired. However, no action was so far taken by the DILG, despite several representation and follow-up made before me at the regional and national office,” he said.
Guialani said his complaint can be a cause for an administrative action against Vice Mayor Uy and Councilor Ocon for neglecting their duties “when they failed to assume their official functions as mayor and vice mayor after Moreno was dismissed”.
Moreno received a new dismissal order last week but lawyer Dale Mordemo argued that the latest dismissal order cannot be given effect because it was already covered by the temporary restraining order they had previously secured from the Court of Appeals.
Mordeno said they also secured a writ of preliminary injunction just before the holidays last year.
“Karon, didto na gyud ko muduul ni Secretary Ano kay gisupport ko siya sa ilang kampanya nga hinloan ang local government units (I choose to seek help to Secretary Ano because I support his campaign to clean local government units),” he said.
Guialani said he stands firm that Moreno is not mayor anymore, this is why he said, Uy and Ocon should take over immediately as top officials of the city.
In 2017, Moreno was able to dodge 11 dismissal orders for the same administrative offenses, grave misconduct, serious dishonesty, and conduct prejudicial to the best interest of the service, for leasing P2.9 million worth of equipment from 2009 to 2010 when he was still governor of Misamis Oriental.
