MULTIPLE charges were filed before the City Prosecutor’s Office (CPO) against a minor who allegedly posted nude photos of another minor in a social media site.
A 17-year-old female student of a state university, and a resident of Lower Rapnaga, Barangay Bago Aplaya Davao City was charged with Child Abuse or Republic Act 7610, Anti Child Pornography Act (RA 9775), Anti Photo and Video Voyeurism Act of 2012 (RA 9995) thru and by the use of Information and Communication Technology Pursuant to (RA 10175).
The Philippine National Police Anti-Cybercrime Group recommended filing of these charges after the entrapment operation they conducted last September 6 when the 15-year-old complainant personally met with the suspect who threatened her that she will broadcast her nude photos online if she will not appear.
Based on the affidavit issued by the complainant, she sent the nude photos to her boyfriend, a freshman student of a state university, and to his alleged cousin months ago.
She said the relationship started last November 2015 through text messaging.
The complainant said she was asked by her boyfriend to send her pictures wearing only underwear on January on his Facebook account and again asked for her nude photo to be sent to him through the Facebook account of his alleged cousin last March 21 saying he is using the account.
Fearful that the boy will break up with her, she agreed with his demand.
Last May, the complainant noted that it was the cousin of her boyfriend who replied to her text, starting a quarrel that angered the suspect who later threatened the complainant to post her nude photos which is in her possession online.
The complainant said on May 5, the suspect contacted her mother and told her he has all her nude photos and threatened to post it online.
She went to meet her boyfriend and begged him to delete all the photos but to no avail.
She said on July 9, she received her nude photos from another Facebook account who confirmed that the photos came from the identified respondent.
She also learned a lot of her friends in their school received her nude photos sent by the Facebook account of the respondent and that her mother was informed about the circulating photos online.
The complainant also said that she suffered emotional trauma, sleepless nights, anxiety, and loss of interest to pursue her studies because of the incident, and that she sought refuge to her mother who accompanied her to report to the proper authorities.
