Ombudsman dismisses Maguindanao town mayor

TALITAY town Mayor Monstair Sabal of the Maguindanao Province was dismissed from the service for serious dishonesty, the Office of the Ombudsman said.

Sabal was also reportedly meted the accessory penalties of the perpetual disqualification from holding public office, cancellation of eligibility and forfeiture of retirement benefits.

The town mayor is also facing charges for three counts each violation of the Anti-Graft and Corrupt Practices, Code of Conduct and Ethical Standards for Public Officials and Employees, and Perjury before the Sandiganbayan.

Ombudsman record showed that Sabal's trouble stemmed from untruthful statements contained in his Statements of Assets, Liabilities and Net Worth (SALNs) for the year 2011, 2013 and 2014.

Sabal misrepresented the contents of his SALNs as he failed to disclose his ownership of five real estate properties located at Doña Luisa Village in Matina and Buhangin District in Davao City, and in Cotabato City.

The Ombudsman said the non-disclosure of the real properties of the town mayor in his SALN constitutes a serious dishonesty as the acts were done fraudulently and committed several times.

Sabal violated the law for failing to make a complete disclosure including the residential lots owned by his wife and son as the law also requires him to acknowledge such property, the Ombudsman added.

Republic Act 3019 and 6717 requires the filing of a true and detailed SALN by every public official declaring their asset, liabilities and net worth, financial and business interests during each year of their incumbency.

The failure to make a true and accurate declaration gives rise to criminal penalties as provided under Republic Act 6713 or The Code of Conduct and Ethical Standards for Public Officials and Employees.

Meanwhile, perjury is committed when a person deliberately makes untruthful statement upon any material matter in a document required by law to be sworn before any public officer.
