SC rules 'with finality' on official's 'overstaying' term in Marawi

THE Supreme Court (SC) denied the motion for reconsideration filed by former Marawi Schools Division Superintendent Monda Macatanong “as no substantial arguments were raised to warrant its reconsideration.”

The high court's latest resolution dated June 27 followed its earlier affirmation of a Court of Appeals decision to terminate the tenure of Macatanong.

The appellate court earlier ruled that “Mona Macatanong was deemed to have already reached the compulsory retirement age of 65 by October 18, 2013 and has no right to continue or prolong the tenure with DepEd-Armm (Department of Education in the Autonomous Region in Muslim Mindanao).”

Macatanong was supposed to vacate her post having reached the age of retirement.

The lower court, however, allowed Macatanong to change her date of birth, which became the basis of her term extension.

Armm Regional Spokesman Amir Mawallil welcomed the development, saying the ruling made by the Supreme Court will allow all the parties to finally take definitive steps forward, without second-guessing the rule of law.

Macatanong's case caused a backlog on documentation and promotion among teachers in the Marawi City schools division.

“The Regional Government has every intent to ensure that the decision of the courts will be carried out accordingly,” Mawallil said.

"From the very start, we knew that the law was on our side and both the Court of Appeals and Supreme Court have consistently affirmed that," Mawallil added.

Mawallil said he hoped that this case will be laid to rest, as the highest court strengthen the decision of the appellate court.

"We trust that our teachers and school administrators will comply with the court's decision and reaffirm their commitment to serving the Bangsamoro," Mawallil added.

The said verdict was overturned by the Court of Appeals in 2015. (PR)
