A 16-YEAR-OLD boy is facing charges before the court after he allegedly raped a young woman in a village in Buhangin District, Davao City last July 16.
Charged with violation of The Anti-Rape Law is "Ejie" (name withheld for being a minor).
In a resolution dated July 20, prosecutor Faizal Padate found probable cause to charge Ejie based on the complaint filed by the victim "Aki" (not her real name).
Aki, in her affidavit, attested that the incident happened around 3 a.m. on July 16 while she was sleeping in a guard post of her boyfriend.
Aki said she was awakened when she felt that someone kissed her. She was surprised when the accused was already on top of her, pointing a knife.
The victim said she was not able to fight back and shout for help due to the fear that the accused might harm her. The accused took off her clothes and proceeded to do his motive. Ejie left after he allegedly raped Aki.
The victim immediately contacted her boyfriend after the incident and looked for the suspect.
Ejie was arrested after Aki and her boyfriend saw him in Buhangin District.
Padate said the custody of the accused is remanded to the Bahay Pag-asa of the Davao City Social Services Development Office while awaiting the disposition of the case pursuant to The Juvenile Justice and Welfare Act.
