TWO teenagers were charged with alarm and scandal before the court, after they were arrested in a riot on Magallanes Street, Davao City, amid an earthquake last April 29.
Charged with Alarm and Scandal are Aldrin Pudpud Dinglasan and Roque Robino Cadate, both residents of this city.
In a two-page resolution approved on May 16, prosecutor Rizalyn Gonzales found probable cause to charge Aldrin Pudpud Dinglasan and Roque Robino Cadate, both residents of this city, based on the complaint filed by the San Pedro Police Station.
The two accused, assisted by their counsel, submitted on May 3 a written request to the prosecution office to avail of their right to preliminary investigation.
Dinglasan and Cadate also made an undertaking that they will submit their counter-affidavits and affidavits of their witnesses within 10 days. But they failed to submit their counter-affidavits thus the City Prosecutor's office resolved the complaint.
According to Senior Police Officer 1 Rizalito Clapiz III, the incident happened during an earthquake last April 29 around 4 a.m.
He said he received a report that a riot between two groups is happening on Magallanes Street.
Clapiz said the youngsters were reportedly engaged in fistfights, throwing of stones and broken glasses on the street, which can cause imminent danger to the residents nearby.
The police saw the two accused holding stones and empty bottles throwing to the people watching them. They also threatened the people to return to their houses or they will be killed.
Clapiz said such act of the two accused caused public disturbance and disrupted the serenity of the residents nearby.
He added that the act of the accused also caused fear, discomfort and panic on the part of the public. (ICT)
