THE Davao City Prosecutor’s Office recommended the filing of charges against a woman who confessed that she killed her husband.
Prosecutor Rizalyn Gonzales, in a resolution dated September 16, found probable cause to indict Lilibeth Sumampong Nonog for parricide under Article 246 of the Revised Penal Code.
Based on the resolution, last September 9, Lilibeth Nognog first approached Caleb Oyanin, the nephew of the victim, Reynaldo Nonog, and told him that she killed her husband.
Oyanin and his friend went to the victim’s house to confirm this and found his uncle bloodied.
Oyanin said they even planned to bring him to the hospital but they were prevented by Lilibeth.
"Ayaw na ninyo dayungi kay patay nana, ako ang gapatay ana (Don’t bother carrying him, he’s dead. I killed him)," Lilibeth allegedly told them.
Barangay kagawad Garnier Elly Lamanda, Lilibeth's cousin, arrived and the latter allegedly admitted that she stabbed her husband with a knife and hit him with a wood in the head causing the victim's death.
Lilibeth was thus endorsed to authorities. Gonzales, in the resolution, said the affidavit of Lamanda and Oyanin stated the confession of the suspect, and found the confession of Lilibeth is sufficient to find probable cause to indict her for parricide.
Gonzales said the confession is in a form of extra judicial confession, spontaneously given by the respondent prior to her arrest, hence, excluded to the constitutional provision on custodial investigation.
"The confession was given before the respondent was arrested or placed under custody for investigation in connection with the commission of the felony, hence, the constitutional requirement of the presence and assistance of the counsel when a person makes an extra judicial confession does not apply," Gonzales said.
Gonzales added there is no question as to the admissibility of the respondent's oral and extra judicial confession. (KVC)
